Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you and Brightloop LLC, a Pennsylvania limited liability company doing business as Solys ("Solys," "we," "us," or "our"), governing your access to and use of the Solys mobile application, website, and related services (together, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Who Can Use Solys
Plain-English: You have to be 18 or older, and you have to be honest about your age.
You must be 18 years of age or older to create an account or use the Service. Solys does not currently offer an experience for users under 18, and we do not knowingly allow anyone under 18 to maintain an account. If we determine, at any time, that an account belongs to someone under 18 — however we learn this — we will suspend or terminate the account and remove its content, without advance notice. Where our systems cannot confirm your age with confidence, we treat that account as under 18 until it's resolved.
You also represent that you have the legal capacity to enter into this agreement, and that your use of the Service will comply with all laws applicable to you.
2. Your Account
Plain-English: Your account is yours, your login is your responsibility, and you need to use your real identity.
You must provide accurate information when creating your account and keep it up to date. Consistent with the Community Guidelines, Solys is built around real identity — you may not create an account impersonating another person, using a fake name, or maintaining more than one personal account for deceptive purposes.
You're responsible for everything that happens under your account, including anything done by someone you've shared your login with. Tell us immediately if you believe your account has been compromised. We're not liable for any loss arising from unauthorized use of your account that results from you sharing your credentials.
We may suspend or terminate your account under the circumstances described in Section 13 (Suspension & Termination).
3. Content You Post ("User Content")
Plain-English: What you post is still yours. You're giving us permission to show it to the people it's meant for — not to sell it, not to use it to advertise at you.
"User Content" means anything you post, upload, or share through the Service — Hard Thing posts, Wins, Sparks, Support Cards, Rally Messages, comments, photos, videos, and anything else. You retain ownership of your User Content. We don't take it from you, and posting it on Solys doesn't transfer any ownership rights to us.
By posting User Content, you grant Solys a limited, non-exclusive, royalty-free, worldwide license to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service to you and the people you've chosen to share it with (your Circle, or wherever else you've directed it within the app's intended features, such as the Vault or Explore). This license ends when you delete the content or your account, except where copies reasonably persist in backups for a limited period, or where content has already been shared with someone else in a way that reasonably continues (for example, a Support Card someone saved to their own Vault before you deleted the original post).
We do not sell your User Content, use it to train third-party advertising products, or share it outside the Service except as described in our Privacy Policy or as required by law.
You're solely responsible for your User Content and for having the rights to post it. Don't post anything you don't have the right to share, and don't post anything that violates the Community Guidelines, which are incorporated into these Terms by reference — a violation of the Community Guidelines is a violation of these Terms.
4. Solys's Content and Trademarks
Plain-English: The app itself, its design, and the Solys name belong to us. You can't rip them off.
The Service — including its design, features, graphics, logos, and the "Solys" name and mark — is owned by Brightloop LLC and protected by intellectual property law. Nothing in these Terms grants you any right to use Solys's trademarks, branding, or proprietary technology outside of your normal, permitted use of the app itself.
5. Acceptable Use
Plain-English: Follow the Community Guidelines. Don't break the app, don't abuse other users, don't try to extract data you're not supposed to have.
In addition to the Community Guidelines (which govern the content and conduct side of using Solys), you agree not to:
- Access or attempt to access the Service using any method other than the interface we provide (no scraping, reverse-engineering, or unauthorized API access)
- Interfere with or disrupt the Service, including introducing malware or attempting to overwhelm our infrastructure
- Attempt to gain unauthorized access to another user's account or any non-public part of the Service
- Use the Service for any purpose that is illegal, or to circumvent the age, identity, or safety mechanisms described elsewhere in these Terms
- Use any automated system (bot, scraper, or similar) to interact with the Service, except tools we have expressly approved
6. Spark Gifting & Payments
Plain-English: Spark is a virtual gift you buy with real money and send to someone. Once you buy it, it's not a bank account — it can't be cashed out, and Apple/Google handle refunds, not us.
Some parts of the Service — currently, Spark Gifting — allow you to purchase a virtual item ("Spark") using real money, and send it to another user as a gesture of support attached to their content.
- Spark has no cash value. It cannot be redeemed, exchanged, transferred for cash, or cashed out by you or by the person who receives it. Spark you send becomes a record in the recipient's Vault, not a spendable balance they can re-gift or withdraw.
- Purchases are made through Apple's In-App Purchase system or Google Play Billing on mobile, or through our designated web payment processor where applicable. Your purchase is also governed by the terms of whichever platform you used to buy it (Apple, Google, or our payment processor), and refunds are handled by that platform according to its own policies — Solys does not directly process refunds for platform purchases and has limited ability to override a platform's refund decision.
- Spark Gifting requires you to be 18 or older and to pass Solys's age-confirmation step for this feature specifically, separate from general account eligibility.
- All Spark purchases are final except as required by applicable law or the policies of the platform you purchased through.
- We may adjust pricing, available Spark denominations, or discontinue Spark Gifting at any time. If we discontinue it, we will provide reasonable notice and information about any unused balance.
7. Reporting, Moderation & Enforcement
Plain-English: We can remove content or accounts that break the rules. We try to be fair about it, but this isn't a courtroom — it's our app.
Solys uses a combination of user reporting and internal review to enforce the Community Guidelines. We may remove content, restrict features, or suspend or terminate accounts that violate these Terms or the Community Guidelines, at our discretion. We aim to apply these standards consistently, but our moderation decisions are not subject to external appeal beyond the in-app processes we provide.
8. Privacy
Plain-English: How we handle your data lives in a separate document. This section just says that document is part of the deal.
Our collection and use of your personal information is described in our Privacy Policy. By using the Service, you agree to the collection and use of information as described there.
9. Third-Party Services
Plain-English: If a link or integration takes you off Solys, we're not responsible for what happens there.
The Service may contain links to or integrations with third-party services (such as payment processors or, in the future, sign-in providers). We don't control those third parties and aren't responsible for their content, policies, or practices. Your use of any third-party service is governed by that service's own terms.
10. Disclaimers
Plain-English: We're a small team doing our best, not a guarantee that nothing will ever go wrong. Use good judgment.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT CONTENT POSTED BY OTHER USERS IS ACCURATE OR APPROPRIATE.
Solys is not a mental health service, crisis line, or substitute for professional support. If you or someone you know is in crisis, please contact a licensed professional or emergency services — Solys is a place to share and receive support from your community, not a clinical resource.
11. Limitation of Liability
Plain-English: If something goes wrong, our responsibility is capped — this is a standard startup protection, not us trying to dodge accountability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIGHTLOOP LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID SOLYS IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.
Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
Plain-English: If your actions on Solys get us sued, you're responsible for that — not the other users who behaved.
You agree to indemnify and hold harmless Brightloop LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms or the Community Guidelines.
13. Suspension & Termination
Plain-English: You can leave anytime. We can end your access if you break the rules, especially the age policy.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if we believe you've violated these Terms or the Community Guidelines, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination (including Section 3's license terms as applied to already-shared content, and Sections 10, 11, and 12) will survive.
14. Governing Law & Disputes
Plain-English: Pennsylvania law applies, and disputes go through Pennsylvania courts.
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service will be resolved in the state or federal courts located in Pennsylvania, and you consent to the jurisdiction of those courts.
15. Changes to These Terms
Plain-English: We can update this document. If it's a big change, we'll actually tell you, not just quietly edit the page.
We may update these Terms from time to time. For material changes, we'll provide reasonable advance notice (such as an in-app notification or email) before the change takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
16. Miscellaneous
Plain-English: The standard legal housekeeping — none of this is Solys-specific.
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Community Guidelines and Privacy Policy, are the entire agreement between you and Solys regarding the Service.
